Deviation from Product Descriptions or Images. Cancellation by Switch. Your subscription renews automatically and you will be charged every 30 days. 9. Authority over Arbitration Agreement. We will process your request to downgrade after receiving your email and receiving all Product(s) in excess of that which you are allowed to borrow under your requested Membership Tier. Thats an easy one--no and no. Switch retains sole discretion to delay, waive, or refund a Purchase Fee for a Delinquent (or previously Delinquent) Account. After the informal dispute resolution process, any remaining dispute, controversy, or claim (collectively, Claim) relating in any way to your use of Switch Services (including but not limited to Switch Content and Products) or relating in any way to Switchs communications with you, will be finally resolved by binding arbitration. You can buy any piece that youre borrowing for its Members Price, which is less than the retail value (sometimes much less). Payment of all filing, administration, and arbitrator fees will be governed by the AAAs rules. This section includes an arbitration agreement and an agreement that all claims will be brought on in an individual capacity (and not as a class action or other representative proceeding). Registration for the Waitlist, including registration for the Waitlist via Facebook, is subject to the same rules and responsibilities as registering for an Account. Registration. If youre on a monthly membership, we charge you each month using your payment method on file. You may not copy and disseminate Switch Content without our expressed authorization or that of a third party that may own such Switch Content. If you are unable to return a Switch Product because it is lost, stolen or destroyed (unless it falls under one of the exceptions below) or if you return any Product with excessive damage (excessive damage is defined as damage that exceeds normal wear and tear and is determined by Switch in its sole discretion), you are liable for that Products Purchase Fee and hereby authorize Switch to charge your payment method for that Products Purchase Fee.
